Enforcing the GNU General Public License

A lawyer for the Software Freedom Conservancy explains recent developments relating to the application of the GNU General Public License. The gist: the GPL is consistently upheld in court, but willful violators have frequently succeeded in unreasonably delaying the day of reckoning, and there are more willful violators than ever.

One other ongoing problem is proprietary kernel modules. The SFC has even seen companies patching EXPORT_SYMBOL_GPL to get the kernel to accept their non-GPL modules, a development Sandler described as “fascinating, shocking, and deeply upsetting.”
